Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Womb to Grow website ("Website") located at wombtogrow.co.uk and our retail store at 28 Exeter Road, Exmouth, Devon, EX8 1PP ("Store"). By using the Website and/or visiting the Store to make purchases you agree to be bound by these Terms.

Definitions

"We," "us," or "our" refers to Womb to Grow.
"You" or "your" refers to the user of the Website or customer in our Store.
"Products" refers to the items available for purchase through the Website or in the Store.

SECTION 1 – ORDERING

Placing an Order: Orders can be placed online at wombtogrow.co.uk or in-person at the Store. Ensure you review all details of your order (products, pricing, shipping, etc.) before submission. Order Acceptance: Your order placement constitutes an offer to purchase. Order acceptance and the formation of a binding contract occur when we send an order confirmation. We reserve the right to reject an order for any reason.

SECTION 2 - PRE-ORDERS

When an item has a status of pre-order, this is for 2 reasons:

1. The product is out of stock.
2. The product has not yet been released.

When possible, we will show the date that the product is available from. This date will not be the date the product is delivered in accordance with the order. This date is when the stock will be made available at the manufacturer. Therefore, this date is subject to change at any given time with no notice.

If you have purchased a pre-order a product, whether that is an out-of-stock product or a product not released, you will be entitled to cancel your pre-order any time before the given date of availability. Our Return, Refund & Warranty Policy also applies.

Full payment is required at time of ordering. If a cancellation is accepted, a full refund we will made to the original payment method in accordance with our Return, Refund & Warranty Policy.

SECTION 3 – PRICING AND PAYMENT

Prices: Product prices are displayed in British Pounds Sterling (GBP) and may be subject to change without notice.
Taxes: Applicable taxes will be added at checkout.
Payment: Full payment must be received before order dispatch.

SECTION 4 – ACCURACY OF INFORMATION

While we make every eƯort to provide accurate information, errors or omissions may occur within product descriptions, pricing, availability, and other areas. We reserve the right to correct any inaccuracies and update information without prior notice. We apologize for any inconvenience this may cause. Womb to Grow is not liable for any losses caused by reliance on potentially inaccurate information. Please verify all information carefully before making any decisions or purchases.

SECTION 5 – SHIPPING AND DELIVERY

Shipping Costs: Shipping costs are displayed at checkout and added to your order.
Delivery Address: You're responsible for providing an accurate delivery address. We are not liable for mis deliveries due to incorrect address information.
Delivery Delays: We'll make all reasonable efforts to ensure timely delivery, but we cannot be held responsible for delays beyond our control (e.g., carrier delays, weather).
Stated delivery time: We will always endeavour to delivery all products within the stated delivery time as per each shipping method. There are exceptions to this, of which we will communicate where possible.

SECTION 7 – INTELLECTUAL PROPERTY

The Website, its content, and Womb to Grow branding elements are protected by intellectual property laws. You may not use them without our prior written consent.

To the extent permitted by law, the Products and Website are provided on an "as is" basis. We make no representations or warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

If you breach this provision by making defamatory statements that cause harm to Womb to Grow's reputation, the company reserves the right to: Request the removal of the defamatory content through the relevant platforms or authorities and/or seek legal action to recover damages caused by the defamation.

These Terms shall be governed by and construed in accordance with the laws of England and Wales

SECTION 15 – DISPUTE RESOLUTION

Any dispute arising from these Terms shall be resolved through good faith negotiation. If unresolved, arbitration or mediation may be pursued.
